Acceptance of Terms
This Terms of Service (TOS) agreement is between a client and Western Medical Assessments (WMA) and its legal successors and assigns.
By accepting this Terms of Service (TOS) electronically, and/or by using Western Medical Assessments services (WMA), you agree to be bound by the following terms and conditions.
WMA provides its services to Clients subject to the following TOS, which may be updated from time to time without notice. You should periodically review the most current version of the same. Failure to comply with the TOS may result in a breach of this Agreement.
Description of Service
WMA is engaged in providing opinions based on medical information and examination of patients. This is rendered merely as an intelligent opinion and is, in no way, an assertion of medical fact.
You understand that WMA’s services may require certain communications from WMA via email or other methods for additional documentation for review. As such, you agree not to withhold these data from the WMA.
Unacceptable Practices
As WMA strives to offer the very best service, there are certain guidelines and policies that must govern its efforts and relationships to our clients. Practices that are in violation of WMA’s guidelines and policies are strictly forbidden and may result in the immediate termination of WMA’s services. Such decisions are at the sole discretion of the latter.
Links to Third Party sites
WMA’s website may contain links to other websites (‘linked sites’). The linked sites are not under the control of WMA, and WMA is not responsible for the contents of any linked site, including without limitation any link contained in a linked site, or any changes or updates to a linked site. WMA is not responsible for webcasting or any other form of transmission received from any linked site. WMA is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by WMA or any association with its operators.
International Use
Recognizing the global nature of the medical practice, you agree to comply with all local rules regarding medical conduct. Specifically, the Client agrees to comply with:
▪ All laws and regulations regarding the transmission of data; and,
▪ All laws and regulations regarding the collection and processing of personal data, including those relating to the transfer of personal medical data.
Termination/Cancellation of Services
WMA, at its sole discretion, may terminate its service, for any reason, including and without limitation, for lack of participation, fraudulent data provided or if we believe there has been a violation of the TOS.
Proprietary Rights
The Client acknowledges and agrees that the WMA’s services and web site contain proprietary and confidential information that is protected by intellectual and proprietary rights laws. Client agrees to not reproduce, duplicate, copy, sell, resell or exploit any portion of WMA’s proprietary and confidential information.
Disclaimer of Warranties
Your use of WMA’s Services is at your own voluntary discretion. WMA’s Services are provided ‘as is’. Thus, WMA disclaims to the fullest extent permitted by law all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of fitness for a particular purpose and non-infringement of proprietary rights.
Tort Claims and Other Claims
You waive all tort claims, strict liability claims and any and all other legal and equitable claims to the extent permitted by law against to WMA, its subsidiaries, affiliates, officers, employees and agents. The relationship between the parties is contractual in nature only.
Jurisdiction
The laws of the Province of Alberta, Canada, shall govern this Terms of Use
